TEKEASE® Business Primary Care™ Terms of Service
These terms and conditions (the "Terms") or (this "Agreement") became effective beginning on December 15, 2014, and were most recently updated on January 12, 2026.
The Business Care Plan Subscription Agreement Terms of Service set forth the terms and conditions under which Dr. Know Systems, LLC d/b/a TEKEASE ON-SITE®, an Illinois limited liability company licensed to do business in Florida, located at 3329 S. Congress Avenue, Suite A234, Palm Springs, FL 33461 (hereinafter "TEKEASE," "we," "us," the “company,” or "our") will provide Client ("Client," or "Clients") with computer support services (collectively, the “service,” “Service,” “services,” or "Services") as set forth in the particular service plan selected by the Client. These Terms apply to all subscription based business service Plans offered by TEKEASE to include the TEKEASE Business Primary Care™ Service Plan and the TEKEASE Business Essential Care™ Service Plan. These Terms explicitly do not apply to the TEKEASE Total Care™ Managed Services Agreement ("TCSA") which has its own Terms of Service available at www.tekeaseonsite.com/business/mstos.
This Agreement governs Client's access to and use of the Plan including all technical support, advice, servicing and software provided. By registering for or using the Service, Client agrees to these Terms.
Acceptance of Terms of Service
Acceptance occurs when Client clicks the "SUBSCRIBE NOW" button on the Site, or by subscribing to the service in person with a TEKEASE technician. Upon receiving any of the Services, Client agrees to be bound by these terms.
Changes to these Terms of Service
We may modify these Terms at any time without prior notice by posting the revised version on our Site. Such changes are effective fifteen (15) days after posting. Continued use of the Services following any such change constitutes agreement to the revised Terms.
Description of Service
TEKEASE technicians will make reasonable attempts to assist Client with software, hardware and network troubleshooting, installation, configuration, and set-up. Services may be provided at a TEKEASE location, remotely over the Internet and by phone ("Remote Services") or on-site at the Client's location.
Service Entitlement
Client consents to TEKEASE's placement of an identification sticker on Client's Computer to verify eligibility. Services are for internal business use only and do not include computer programming, software bug fixes, or hardware repair services. No parts are included in any TEKEASE service plan.
One-Time Services
Certain services may incur additional fees disclosed in advance. Client may request follow-up service related to a specific "event" at no additional charge for seven (7) calendar days, provided it concerns the same disclosed issue.
Service Package Subscriptions
Subscriptions cover one (1) computer physically located at the client’s primary business address unless stated otherwise. The minimum term is one (1) year, renewing automatically on a month-to-month basis after the original term unless Client provides prior written notice of cancellation.
On-Site Services
Technical support provided at the Client’s primary business address may incur additional fees. Discounted on-site services are subject to current standard rates. TEKEASE technicians must have timely access, a safe working environment free of hazardous materials, and cooperation from an authorized representative at least 18 years of age. Denied service due to site unreadiness results in a $125 missed appointment charge.
Supported Products
TEKEASE covers support for hardware, operating systems, and software manufactured by Microsoft or purchased from TEKEASE, provided such products are still supported by the original manufacturer.
Data Collection and Consent Policies
Information from Client’s Computer may be transmitted to TEKEASE in connection with certain Services, including remote computer monitoring. By agreeing to these Terms, Client agrees to the Privacy Policy at www.tekeaseonsite.com. TEKEASE reserves the right to monitor communications for quality control and security.
Customer Authorization of Remote Access
By registering for the Service, Client provides explicit authorization for TEKEASE technicians to use the tools deemed necessary to perform the Service, including obtaining remote access to Client's computer, network, and peripherals during service sessions.
Labor Guarantee
All business labor has a 7-day guarantee from the date of service. Modification of systems or hardware by the Client, or damage from electrical surges or foreign objects, voids this guarantee.
Payment and Credit Card Billing
Client authorizes TEKEASE to charge the provided credit card for all fees. TEKEASE may increase fees with 30 days' advance notice. Late fees of 1.5% per month apply to unpaid balances. Client agrees to reimburse TEKEASE for all expenses incurred to recover monies due, including attorneys' fees.
Termination
Client may terminate a Service Package by providing written notice to:
TEKEASE, 3329 S. Congress Avenue, Suite A234, Palm Springs, FL 33461.
Early termination of a term commitment results in a fee equal to 50% of the remaining monthly rates.
Disclaimer of Warranties
SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TEKEASE MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET CLIENT'S SPECIFIC REQUIREMENTS. CLIENT IS SOLELY RESPONSIBLE FOR DATA BACKUP.
Limitation of Liability
IN NO EVENT WILL TEKEASE, ITS EMPLOYEES, OR CONTRACTORS BE LIABLE FOR INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES. TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID BY THE CLIENT DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Choice of Law; Jurisdiction; Arbitration
This Agreement is governed by the laws of the State of Florida. Any dispute must be brought exclusively in the state or federal courts of Palm Beach County, Florida. Disputes not resolved via negotiation shall be settled by binding arbitration administered by the AAA in the State of Florida. CLIENT WAIVES THE RIGHT TO A JURY TRIAL OR CLASS ACTION.
General Information
This Agreement, including the Online Terms of Service at https://tekeaseonsite.com/business/bctos, constitutes the entire agreement between the parties. If any provision is held invalid, the remainder remains in effect.
